Due Diligence Before Buying Property

Most property disputes we see could have been avoided by checks that would have taken a fortnight before the purchase.

Title

Trace ownership back through the chain of title for the period your advisers recommend, and confirm each transfer was validly executed and registered. A gap in the chain is a problem to resolve before purchase, not after.

Encumbrances

Obtain an encumbrance certificate covering the relevant period to reveal registered mortgages, charges and liens. Ask the seller directly, in writing, about unregistered claims — family arrangements and oral tenancies frequently do not appear on any register.

Approvals and use

For developed property, verify the layout and building plan approvals, the commencement and completion certificates, and the occupancy certificate. Confirm the land use permitted under the applicable master plan matches what you intend to do with it.

Taxes and dues

Check that property tax, electricity and water dues are cleared. Outstanding dues generally attach to the property and become the buyer's problem.
